Booking terms and conditions

Last updated

The terms that apply when you book a course, NVQ or distance learning course with us: payment, cancellations, transfers, refunds and what we expect on the day.

1. About these terms

These terms apply to every booking made with Site Safety Training Consultants Limited ("Site Safety Training", "we", "us", "our"), whether online, by phone or by email. Please read them before you book. When you tick the box at checkout and pay, or confirm a booking with us in writing, you agree to them.

If you're booking as a consumer, nothing in these terms affects your legal rights. Where a section applies only to consumers or only to business customers, it says so.

2. Definitions

You, the booker
The person or organisation that makes and pays for the booking. You don't have to attend.
Delegate
Each person attending a course or working towards a qualification. A delegate can be you or someone you book for.
Course
A tutor-led course with set dates, run in the classroom or live online.
NVQ
A work-based qualification assessed through a portfolio of evidence from the delegate's job. NVQs have no set dates.
Distance learning course
A self-study course with online access, studied at the delegate's own pace.
Awarding body
The organisation that sets the standard and issues the certificate, such as CITB, NEBOSH, IOSH, EUSR or an NVQ awarding body.
Consumer and business customer
You're a consumer if you book for yourself, wholly or mainly outside your trade, business or profession. Otherwise, for example when an employer books for its staff, you're a business customer.

3. Making a booking

  1. A booking is confirmed, and our contract with you starts, when we've received payment and emailed you a booking confirmation with your booking reference.
  2. While you complete checkout we hold the places for a short time. If payment isn't completed, the places are released.
  3. You must give each delegate's full name, email address and phone number. You're responsible for making sure these details are correct, and for telling each delegate that you're sharing their details with us so we can book them in (see our privacy policy).
  4. You're responsible for making sure each delegate meets the entry requirements shown on the course page, such as a previous qualification, a valid test result or a level of spoken and written English.
  5. We email you, the booker, the booking confirmation. We email each delegate their own joining details: dates, times, and the venue or how to join online. If a delegate hasn't received their joining details two working days before the course starts, please call us.
  6. If a delegate has a disability, a medical condition or another need that may affect their training or assessment, please tell us when you book and at least 14 days before the course starts. We'll make reasonable adjustments in line with the Equality Act 2010. Adjustments to exams and assessments follow the awarding body's rules and may need evidence. If we're not told in time, we may not be able to make the adjustment, and a delegate who can't then take part isn't entitled to a refund.

4. Prices and payment

  1. Prices are in pounds sterling and exclude VAT, shown as "+ VAT". VAT at the current rate (20%) is added at checkout and shown on your booking confirmation.
  2. Courses, NVQs and distance learning are paid in full when you book. There is no deposit and nothing more to pay later.
  3. Online payments are made by debit or credit card through our payment provider, Stripe. We never see or store your full card details. Business customers can ask us about paying by invoice; this is by arrangement and we may ask for a purchase order.
  4. Unless the course page says otherwise, the price includes tuition, course materials, and the awarding body's registration and certificate fee. Where an exam or awarding body fee is charged separately, for example on some distance learning courses, the course page says so.
  5. We may change our prices at any time, but the price on your booking confirmation won't change for that booking. If a price on our website is clearly wrong, we'll contact you before we accept the booking, or cancel it and refund you in full.
  6. Discounts and offers can't be combined unless we say they can, and don't apply to bookings made before the offer started.

5. If you cancel

  1. To cancel, please tell us in writing by email (reply to your booking confirmation) and quote your booking reference. If you call us to cancel, please confirm it by email within 24 hours. The cancellation takes effect on the day we receive your email.
  2. Courses. We refund the course fee (with the VAT on it) on this scale, counted back from the first day of the course:
    When you cancel Refund
More than 30 days before the course starts 100%
    12 to 30 days before 75%
    7 to 11 days before 50%
Less than 7 days before, or the delegate doesn't attend No refund
  3. Your right to cancel as a consumer. If you're a consumer, you can also cancel within 14 days of the date of your booking confirmation and get a full refund, as long as the course hasn't started. After those 14 days, the scale above applies. NVQs and distance learning have their own rules, below.
  4. NVQs. Soon after you enrol we register the delegate with the awarding body and set up their assessment. If you cancel before that work starts, we refund the fee in full. Once it has started, the fee isn't refundable, including if a delegate withdraws or doesn't complete. If you're a consumer and you cancel within 14 days of booking, we refund the fee in full, less a fair amount for any work you asked us to start in that time.
  5. Distance learning. Distance learning can't be refunded once the delegate has started the course by logging in to the study materials. If you're a consumer, you can cancel for a full refund within 14 days of booking as long as the course hasn't been started.
  6. If a delegate doesn't attend and we haven't received a cancellation, the full fee is charged and no refund or credit is given.
  7. We pay refunds to the card used to pay, within 14 days of agreeing the refund.

6. Transfers and substitutions

  1. Moving to another date. You can ask to move a delegate to another date of the same course. Please ask in writing by email (reply to your booking confirmation) and quote your booking reference. Transfers depend on places being available, and this fee applies:
    When you ask Transfer fee
More than 30 days before the course starts Free
12 to 30 days before 25% of the course fee
7 to 11 days before 50% of the course fee
Less than 7 days before 75% of the course fee
If the new date costs more, you pay the difference. The fee is worked out on the price you paid, after any discount.
  2. Sending someone else. You can send a different person in a delegate's place at no charge. Tell us in writing at least 24 hours before the course starts, with the new delegate's name, email address and phone number. They must meet the course's entry requirements.
  3. NVQs can't be transferred to another person. We may agree to pause an NVQ or extend its deadline; extra fees may apply, including any charged by the awarding body.
  4. Distance learning access is personal to the delegate and can't be transferred or shared.

7. If we change or cancel a course

  1. Occasionally we may need to cancel or postpone a course, or change its time, venue or how it's delivered. This could be because too few people have booked, the trainer is ill, or because of severe weather, a venue problem or a technical failure. We'll tell you as soon as we can, and normally at least 7 days before the course starts unless the cause was sudden.
  2. If we cancel or postpone, you can choose to move to another date of the same course (or an equivalent course) free of charge, or have a full refund of what you paid for that course. We pay refunds within 14 days.
  3. Courses are delivered by qualified trainers approved by the relevant awarding body. Some courses run at venues operated by third parties. Either way, we remain responsible to you for your booking and are your point of contact.
  4. We're not responsible for travel, accommodation or other costs you've arranged yourself if a course is changed or cancelled, except as set out in section 14. We recommend booking flexible or refundable travel.

8. On the course

  1. Attendance. Delegates must attend the whole course, arrive on time and take part in every session and assessment. Awarding bodies require full attendance, so a delegate who arrives late or misses part of a course may not be allowed to continue or receive a certificate. No refund is due in that case.
  2. Identification. Delegates must bring valid photo ID, such as a passport or photocard driving licence. On live online courses they'll be asked to show it on camera.
  3. False documents. If a delegate gives false, altered or invalid identification, certificates or test results, they'll be removed from the course, the full fee is forfeited and we may report it to the awarding body.
  4. English. Courses are taught and assessed in English. Delegates need to understand and communicate in English well enough to take part and complete the assessments. If a delegate needs language support, please tell us at least 14 days before the course; extra charges may apply.
  5. Conduct. Delegates must treat trainers and other delegates with respect and follow the trainer's and the venue's health and safety instructions. The trainer may remove anyone who is disruptive, abusive or under the influence of alcohol or drugs, without a refund.
  6. Live online courses. Delegates need a laptop or computer with a webcam, microphone and speakers, a reliable internet connection, and a quiet, private place to work. Where the awarding body requires it, as CITB does, the camera must stay on throughout. Please test the joining link before the course. We're not responsible for problems with a delegate's own equipment or connection that stop them taking part.
  7. Pre-course work. If a course has pre-course reading or work, delegates must complete it before the first day.

9. NVQs

  1. NVQs show competence in a job role. They're assessed through a portfolio of evidence from the delegate's work (such as photographs, documents and witness statements), observations, professional discussions and knowledge questions, as the awarding body requires.
  2. Delegates must be working in a role that lets them produce the evidence for the qualification. Some card schemes also require a valid CITB Health, Safety and Environment test. Please check eligibility before you book; we may confirm it with you before registration.
  3. We assign an assessor, who agrees an assessment plan and timescales with the delegate. How long an NVQ takes depends on its level and on how quickly the delegate provides evidence.
  4. Delegates must keep in contact with their assessor, respond to feedback and submit evidence by the agreed dates. All evidence must be genuine and the delegate's own, and gathered safely and lawfully. If a delegate doesn't provide enough evidence, or misses deadlines, they may not achieve the qualification, and no refund or credit is given.
  5. The awarding body issues the certificate once the portfolio has been completed and verified. This usually takes 4 to 6 weeks after sign-off.

10. Distance learning

  1. After payment we email the delegate their login details, usually within one working day.
  2. Access lasts for the period shown on the course page. When it ends, the materials are no longer available.
  3. The course page explains how the exam or assessment works, any tutor support, and any exam fee that's charged separately. Exams are taken under the awarding body's rules.
  4. Login details are for the delegate only. If they're shared, we may withdraw access without a refund.

11. Results and certificates

  1. Certificates are issued by the awarding body once a delegate has passed and the fee has been paid in full. Digital certificates usually arrive within 2 to 4 weeks of the course. Some, including NEBOSH certificates, can take up to 12 weeks after results are published.
  2. How long a certificate is valid for, and whether a refresher course is needed, is set by the awarding body. For example, CITB SMSTS and SSSTS certificates are valid for 5 years.
  3. If a delegate doesn't pass, we'll explain the resit options. Resits are charged separately unless the course page says otherwise.
  4. Replacement or printed certificates are available for the awarding body's fee.

12. Course materials

Course materials, presentations, e-learning content and assessments belong to us, the awarding body or our licensors. Delegates may use them for their own study only. They mustn't be copied, shared or published, and live online sessions mustn't be recorded, without our written permission.

13. Your information

We use the details you give us to manage your booking. We share delegates' details with the awarding body, to register them and issue certificates, and with the trainers and venues that deliver the course. Our privacy policy explains what we collect, why, who we share it with and your rights. We send marketing emails only to people who have agreed to receive them.

14. Our liability

  1. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law doesn't allow us to limit.
  2. Business customers: our total liability for a booking is limited to the fees paid for that booking. We're not liable for indirect or consequential loss, or for loss of profit, business, earnings or contracts, or for travel and accommodation costs.
  3. Consumers: we're responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We're not responsible for loss that isn't foreseeable. Our courses are for personal training, so we're not liable for business losses.
  4. We're not responsible for delegates' personal belongings brought to a course, unless loss or damage is caused by our negligence.
  5. We're not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, illness, strikes, government restrictions or failures of utilities or online services. If one affects your course, section 7 applies.

15. Complaints and appeals

  1. If you're unhappy with anything, please tell us as soon as possible, ideally within 14 days, by phone or in writing. We'll acknowledge your complaint, reply in full within 10 working days, and aim to resolve it within 21 working days.
  2. To appeal against an assessment decision or result, write to us within 14 days of receiving it. We'll review it under the awarding body's appeals procedure and reply within 21 working days. If you're still not satisfied, you can then take the appeal to the awarding body.

16. General

  1. We may update these terms from time to time, for example when the law or awarding body rules change. The terms that apply to a booking are the ones published when it was made. If a change affects a booking you've already made, we'll tell you.
  2. If a court decides that part of these terms isn't valid, the rest still applies.
  3. The contract is between you and us. Nobody else has any right to enforce it.
  4. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you're a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
